Bantu Khaya Group respectsthe privacy ofevery customer, and complies with all applicable laws for the protection of customer’s privacy, including, without limitation, all Canadianprivacy laws, and The Canada's Protection of Personal Information and Electronic Documents Act (PIPEDA). This Privacy policy explains how Bantu Khaya Group collects, and uses personal data you give your consent to when you provide to us during the registration of your Customer Account. Please note that all personal data is duly encrypted and stored in a secured servers. 

Given the nature of some of the PROTRACC Software modules and services, some data may be collected, used, or disclosed by customer who access the PROTRACC (SAAS) software. We encourage you to be mindful of this when considering your activity on the PROTRACC software.

You may share personal information when using the PROTRACC software. One example is when you submit financial data about your organization on the Software, for evaluation and monitoring.

This Privacy Notice iswrittento complywith the Canadian Criminal Code RSC 1985, Canada Anti-Spam Legislation (CASL),the EU GDPR directives and The Canada's Protection of Personal Information and Electronic Documents Act (PIPEDA).This Privacy Notice applies to personal data which we process relating to customers who:

  • Created an Account on the PROTRACC Software
  • Make a Purchase for PROTRACC Software module access andservices
  • Subscribefor PROTRACC marketing Emails;
  • Contact Bantu Khaya Group for inquires and support.

This Privacy policy also describes what rights you have regarding your information, how you give your consent, and how you can withdraw your consent.Bantu Khaya Group Inc owns and operates the PROTRACC Software and associated services, including, without limitation,www.protracc.com,(collectively, the "Bantu Khaya Groupservices and software"). 

2.    Acceptable Use

PROTRACC uses your personal information to operate, provide, develop, and improve the products and services that we offer. PROTRACC work to protect the security of your personal data during transmission by using encryption protocols and technology. It is important for you to protect against unauthorized access to your account, password and to your computers, and devices. Be sure to sign off properly when finished using a shared computer. 

Ifyou are not comfortable with any aspect of this Privacy Statement. You should immediately discontinueyour access to the PROTRACC software and services.

3.    Summary of Personal Information 

We process customer Data only when it is necessary for the performance of a contract with you, or for compliance with a legal obligation to which we are a subject, except where such interests are overridden by your interests or fundamental rights of freedom for which require the protection of your Data.Our obligationis to render and improve our services in an efficient, safe and protective manner. For we want to provide everyone with a fair and enjoyable experience to use our services.

4.    Types Of Data We Collect From You

For the provision of our services, we may collect and process the following personal data about you, but only with your consent;

  • Personal Profile Information. When you register an accountto access PROTRACC Software, you will provide your first and last name, your email address, addressand your chosen password.
  • Business information: customers may provide their business informationon our Software or by registering for, or providing contact information. Specifically, we collect demographic and contact information, such as first and last name, title, company name, image, financial data, address,   business phone number, business e-mail address, and professional association from visitors and representatives of prospective customers who wish to receive information about PROTRACC and its products and services.
  • Other data provided by you voluntarily:You may choose to voluntarily provide other information to us that we do not request, and, in such instances, you are solely responsible for such information.

By submitting information to PROTRACC on or through this Software or through any other means, you acknowledge that you have read this Policy, understand it, agree to its terms, and authorize PROTRACC to collect, use and disclose information pursuant to this Policy.

5.    How We Use Your Data

We will only use your data in the manner the law allows us to. Most importantly, we will use your data in the following circumstances;

  • To Identify you. Personal identification information is collected and processed for the purposes of Customer identification as well use of services  and workflow optimization software. Additionally, this information may be used to provide customer with support, letting them know about upcoming updates or improvements, providing information regarding changes of any Terms of service (including changes to this Policy) as well as other important information.
  • To create and maintain trusted environment. We verify or authenticate information or identifications provided by you (such as email or project details). We also use collected information to detect and prevent fraud, spam, abuse, security incidents, and other illegal and harmful activities.
  • To Create Aggregated Statistical Data, to Carry out Market Research and Analysis necessary for running out our business, to improve our services we use aggregated and/or inferred non-personal information enabling us to evaluate our customer needs, sales and other trends of our activities.
  • Defend ourselves in litigation and investigations and prosecute litigations
  • To comply with legal and regulatory obligations.

6.    Transfer Of Data

Your information, including Personal Data, may be transferred to and maintained on computers located outside of your state or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

PROTRACC will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

Your personal data is generally stored until we receive a request to remove it or as otherwise required by internal policies and procedures, applicable law and / or contractual terms. Data we collect is stored in Canada and is subject to our Policy, except when data is submitted to PROTRACC outside of Canada. If data is submitted to PROTRACC outside of Canada, then the data storage and processing may vary depending on the sender’s location and method of submission. PROTRACC uses reasonable physical and technical measures to prevent unauthorized access or loss, and / or unlawful processing. Usage of this Website is not permitted outside of Canada.

We do not use your personal data for automated decision-making or profiling, which have a legal or similarly significant effect on Customers.

8.    Your Data Privacy Rights and Choices
We enable you to make numerous choices about your data: Below is the following data protection rights you have when using our software. You may choose to use this privacy right and choices below for the protection of your data. 

  • Right to update or correct: Suppose you wish to access, correct, update or request deletion of your personal information. In that case, you can do so at any time by contacting us through the customer services portal or at the information provided at the bottom of this Privacy Policy.
  • Right to access your data: If you request access to your data, we will confirm whether we hold your information and provide you with a copy,  explaining how we process it and why, how long we store it for, and your rights associated with it.
  • Right to Delete your Data:If you request the deletion of your personal information, we will erase it. Please note that we will need to retain any  information required to fulfill our legal obligations or establish, exercise, or defend a legal claim.
  • Right to Restrict the processing of your data: You can ask us to restrict your personal information or request the portability of your personal information. Again, you can exercise these rights by contacting us through the customer services portal or at the information provided at the bottom of this Privacy Policy.
  • Right to opt-out from receiving marketing emails: You have the right to opt-out of the email marketing communications we send you at any time.You can exercise this right by clicking on the "unsubscribe" or "opt-out" link in the marketing emails we send you. We will process your request within a reasonable time after receipt.
  • Withdraw Your Consent:Similarly, if we have collected and processed your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted before your withdrawal, nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

9.    Sensitive Data

PROTRACC does not collect Sensitive Data from its Customers. If you are a customer and you submit any form of Sensitive Data via the PROTRACC software,e.goperation data, project data, human resources, and financial sensitive data, you agreeing to do so at your own risk.

10.    Disclosure Of Data

Bantu Khaya Group may disclose your Personal Data in the good faith belief that such action is necessary to:

  • To comply with a legal obligation
  • To protect and defend the rights or property of PROTRACC(SAAS) by BANTU KHAYA GROUP
  • To prevent or investigate possible wrongdoing in connection with the Service
  • To ensure compliance and governance with appropriate governing body
  • To protect the personal safety of customer of the Service or the public
  • To protect against legal liability

All personal data is encrypted and stored in secure servers.We employ modern and secure techniques to protect our systems from intrusion by unauthorized individuals, and we regularly upgrade our security as better methods become available.

Please be aware that no securitymeasures online are perfect or impenetrable. Therefore, although we use industry-standard practices to protect your privacy, we cannot (and do not) guarantee the absolute security of personal data.

12.    Service Providers

We may employ third party companies and individuals to facilitate our Service ("Service Providers"), to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used.For example our IT, telephony and system administration and hosting, research and analytics, marketing, sales, customer support and data enrichment. These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

We may use third-party analytics Providers to monitor and analyze the use of our Service.

Google Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports software traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.

You can opt-out of having made your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. PROTRACC continually strives to implement new technologies and processes to protect you better, your privacy, and your use of the PROTRACC service. As a result, changes to this privacy policy may be made by PROTRACC from time to time. In no event will these changes result in the degradation of any security measures designed to protect you from unauthorized disclosure.

16.    Children's Privacy

Our Service does not address anyone under the age of 18 ("Children").

We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Children has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

This terms and the relationship between you and Bantu Khaya Group is governed by the laws of the Supreme court of Canada, including the Canadian Criminal Code RSC 1985, Canada Anti-Spam Legislation (CASL), The Canada's Protection of Personal Information and Electronic Documents Act (PIPEDA), and the local laws of where you reside, without regard to Its conflict of law provisionsshall govern this privacy policy and terms of service and other related services offered by Bantu Khaya Group.
